Federal records show EPA withheld chemical risk assessments from East Palestine residents

Newly released documents reveal that EPA and federal agencies possessed models projecting severe chemical exposures after the 2023 train derailment, while publicly assuring the Ohio community it was safe.

Newly released federal records have revealed that following the February 2023 Norfolk Southern derailment in East Palestine, Ohio, EPA and federal agencies possessed detailed models projecting severe and potentially fatal chemical exposures that were not disclosed to residents. Early government projections indicated that 17,972 people could have been exposed to phosgene—a byproduct of burning vinyl chloride—yet these figures were never shared with the public. Despite these internal concerns, EPA officials including then-Administrator Michael Regan visited the community weeks after the accident and publicly assured residents that the area was safe and that there were no gaps in testing. Internal EPA documents obtained through Freedom of Information Act requests characterize the released hazardous substances as an "imminent and substantial threat to public health and the environment." The records also show the EPA monitored and tracked residents and community activists on social media platforms while narrowing portions of Norfolk Southern's environmental testing program. Vice President JD Vance and current EPA Administrator Lee Zeldin requested an investigation by the EPA's Office of Inspector General in August 2026, citing the Government Accountability Project watchdog report that documented the withheld risk assessments.

How could this affect you
Traced by who's actually in the path of this — not everyone is.
Likely
If you are a resident of East Palestine or other communities downwind from industrial hazard sites
Disclosure gaps in government risk communications could delay residents' voluntary protective measures (relocation, medical screening, water/food sourcing decisions) and impede ability to pursue health claims
Possible
If you are monitoring EPA regulatory credibility or its emergency response protocols
A sustained investigation into why risk projections were withheld could lead to procedural changes requiring earlier and more transparent disclosure of modeling data to affected communities in future derailments or industrial accidents
Possible
If you hold Norfolk Southern stock or track railroad industry compliance
Renewed scrutiny of EPA's relationship with the railroad (including oversight of testing programs) could influence settlement negotiations, regulatory requirements, or shareholder liability risk in ongoing litigation
